Appropriations

The Probate Court has concurrent jurisdiction with the general division of the court of common pleas to hear land appropriation cases. For more information, please review Ohio Revised Code Chapter 163.

What documents are needed to initiate a case?

  • Petition for Appropriation (MUST be typed complete with E-Signatures or ink signatures)
  • Affidavit and Request for Service by Publication (the Court will prepare the judgment entry)
    • For Defendants whose address is unknown
    • For Unknown Defendants
  • Declaration of Intention to Take Possession (if applicable)
  • Preliminary Judicial Report
  • Resolution of Appropriating Agency
  • Supplemental Documents (any supporting documents not already listed above)

When will I have a hearing?

The Probate Court will NOT set a hearing on your petition until payment has been received by the Clerk’s Office and service of notice to all parties completed.

E-Filed Petition and Document Status:

  • If the filing is accepted, you will receive notification by email.
  • If the filing is not accepted, you will receive notification of the reason for rejection by email. Corrected filings may be resubmitted within 72 hours. After 72 hours, you must create a new filing.

What are the required filing fees?

Plaintiff(s) petition payment of $250.00 made by certified check or money order. (Please reference on the check’s memo line the Plaintiff’s name or Plaintiff’s counsel of record)

Send a separate certified check or money order for the Appraised Land Value. (Please reference on the check’s memo line the Plaintiff’s name and “Appraised Land Value”)

Attorneys representing the State of Ohio and Cuyahoga County DO NOT need to send the $250.00 petition payment.

All other users must mail both checks to the Probate Court Clerk’s Office:
